In Cameroon, different lands are available for purchase, each with each having their own unique characteristics. However, caution is paramount during the land acquisition process to prevent loss or protracted litigation.
Two primary categories of land exist in Cameroon: Registered Land and Unregistered Land.
1. Registered Land (Land Certificate):
The most secure form of land ownership is through a land certificate. According to Decree No. 76-165 of 27th April 1976, which outlines the conditions for obtaining land title in Cameroon, and further amended by Decree No. 2005/481 of 16 December 2005, a land certificate is the official certification of ownership. Articles 2 and 24 of the Ordinance establish a land title as unassailable, inviolable, and definitive. Therefore, it is strongly advised to purchase land with a valid land certificate.
2. Unregistered Land (land without a land certificate):
This category includes Native lands, Village layouts, and state lands. Acquiring any of these lands entails a high risk and demands meticulous due diligence to avoid potential loss. After successful acquisition, immediate steps should be taken to occupy the land and initiate the registration process to obtain a land certificate.
